CEPU win in NSW/ACT changes unfair policy

(20 April, 2009): A dispute over daily pre-ride motorcycle checks in NSW and the ACT has resulted in an important victory for postie members. 

The CEPU was concerned that the declaration for verifying that pre-ride checks had been completed placed too much responsibility on individual posties.

There was serious concern that responsibility for any legal issues arising from the completion of the checks had been unreasonably placed on individual posties when in fact any possible legal and/or financial consequences arising should reside with Australia Post. 

We sought and undertaking from Post that individual posties would be indemnified against any legal and financial risks associated with the pre-ride checks

As a result of proceedings in the AIRC the declaration that has to be signed to verify that pre-ride checks have been completed has been amended to ensure that posties are protected against any legal or financial risk associated with the pre-ride checks. 

It is now clear that Post has the legal duty of care and will bear the legal and financial risks associated with the pre-ride checks. 
 
The CEPU will be taking further action to address serious concerns with the process and procedures for the Pre-Ride Inspection Checklist. 

We will be seeking to achieve a number of outcomes:

  • All delivery employees have the appropriate skills and/or qualifications to complete the Motor Cycle Daily Pre-Ride Inspection Checklist.
  • There is appropriate training and education to ensure delivery employees to skills to complete the Motor Cycle Daily Pre-Ride Inspection Checklist.
  • Appropriate time is allowed daily MOS assessments for delivery employees to complete the tasks associated with the Motor Cycle Daily Pre-Ride Inspection Checklist.
